How Is Burglary Defined Under Utah Law?
Under Utah Code section 76-6-202, burglary is defined as entering or remaining unlawfully in a building or any part of a building with intent to commit a listed offense. That list includes a felony, theft, assault, lewdness, sexual battery, specified offenses involving a child, voyeurism, recorded or photographed voyeurism, and distribution of images obtained through voyeurism. The charge doesn’t require completing the intended offense. The prosecution must prove beyond a reasonable doubt that the required criminal intent existed at the time of entry or remaining.
Utah law also defines what “entering or remaining unlawfully” means: it applies to premises not open to the public where the person lacks a license or privilege to enter or remain. Entry itself includes intrusion by any part of the body or by a physical object under the person’s control. A dwelling under Utah law is a building usually occupied by a person lodging there at night, regardless of whether someone was present at the time of the alleged offense.
